Agreement to These Terms

These Terms of Service form an agreement between the visitor or client and TAT CHUAN AUDIO PTE LTD, a company registered in Singapore at 18 Tannery Lane #05-02 Lian Tong Building 347780, Singapore (SG). By browsing this website, submitting an enquiry or booking a service, the person doing so confirms that they have read these terms, that they understand them and that they accept them.

The listening room described on this website is a working room rather than a retail floor. Every engagement begins with a conversation about the room, the cabinet and the listening habits of the household, and the terms below describe how that engagement is run from the first enquiry through to the handover evening and any care that follows.

Where a client does not accept these terms, the correct course is to stop using the website and to contact the desk before any booking is made. The desk can be reached at forward@tatchuanaudio.com or on +18588818793 during business hours, and questions about the terms are welcome before a decision is taken.

Definitions Used in These Terms

The words below carry the meaning given here throughout these terms. Where a word is not defined, it takes its ordinary meaning in the context of a listening room and workshop in Singapore.

Eligibility and Client Responsibility

A client must be at least eighteen years old, or must have the consent of a parent or guardian, to make a booking. Where a client represents a company or another organisation, the client confirms that they are authorised to bind that organisation to these terms.

The client is responsible for the accuracy of the information supplied. This includes the description of the room, the cabinet model and age, the history of previous repairs and any detail about the building that affects access to the installation site. An inaccurate description may mean that a quotation needs to be revised or that a scheduled visit has to be rearranged, and any additional cost caused by the inaccuracy is carried by the client.

The client is also responsible for making sure that the room is safe to work in. Walkways must be clear, the cabinet must be reachable and any building approval needed for the work must be in place before an engineer arrives. Where the company is asked to work in a space that is not ready, the engineer may stop and the visit may be charged as a failed booking.

Website Use and Content

The website is provided for information and enquiry. It is not a shop, and it does not accept payment directly. A visitor may read the pages, print a copy for personal reference and share a link, provided that the content is not altered and is not presented as the work of another person.

The descriptions on the website are written to give a clear picture of how the company works. They are not a technical specification for a particular cabinet, and they do not create a promise that a particular result will be achieved in a particular room. Every engagement is scoped in writing after the initial conversation, and that written scope takes precedence over a general description on the website.

The website is made available as it is. From time to time a page may be unavailable while it is being updated, or a fault may interrupt the service. The company takes reasonable care to keep the website accurate and available, but does not promise uninterrupted access or the absence of errors.

Bookings and Scheduling

A booking is made when the desk confirms a date in writing after receiving an enquiry. A request on its own does not reserve a slot. Listening rounds, cabinet tune days and handover evenings are held in the evening or at a time when the building is quiet, so slots are limited and early notice is helpful.

The desk may ask for a short description of the room and the cabinet before a date is offered, because the room is prepared in advance for the imagined client. This preparation may include the choice of listening set, the arrangement of the bench and the materials that are brought up to the room.

Where a booking involves more than one visit, the visits are scheduled as a sequence so that the cabinet is not left open for longer than the work requires. The client is told at the time of booking how many visits are expected and what each one covers.

Quotations and Pricing

A quotation is prepared after the initial conversation and is valid for the period stated on it, normally thirty days unless another period is written on the document. The quotation sets out the scope of the work, the materials expected to be used, the number of visits and the price.

Quotations are based on the information available at the time. If the work reveals something that could not be seen before, such as a damaged frame or a driver that does not match its card, the desk will explain the situation and provide a revised quotation before proceeding. Work is not carried out beyond the agreed scope without written approval.

Prices are stated in Singapore dollars unless another currency is written on the quotation. Where goods and services tax applies, it is shown separately on the invoice in the manner required by law. A change in the rate of any applicable tax may change the amount due, and the client will be told before any additional amount is charged.

Payment Terms

The payment terms are set out on the quotation and on the invoice. In the ordinary course, a deposit is required to reserve a tune day or to begin a build, and the balance is due on or before the handover. A smaller job, such as a driver match, is usually invoiced on completion.

Payment may be made by bank transfer or by card through the provider named on the invoice. The company does not accept cash through the post and does not ask for payment details by email. A message that claims to be from the company and asks for payment to a new account should be checked by telephone before any transfer is made.

An invoice that remains unpaid after the due date may attract a late charge as stated on the invoice and may cause later work to be paused. The company will contact the client before pausing any work, so that an arrangement can be made where one is needed. Where a payment dispute arises, the desk will work through the invoice with the client line by line.

Cancellation and Rescheduling

A client may cancel or reschedule a booking by contacting the desk by email or telephone. Notice given more than seventy two hours before the booked time allows the slot to be offered to another client and normally causes no charge, apart from the cost of any material already cut for the job.

Notice given within seventy two hours may be charged as a late cancellation, because the room has been prepared and the engineer reserved. The charge is set out on the quotation. The desk will always discuss the reason for a late cancellation and will waive the charge where the circumstances make that fair, for example in the case of a sudden illness or an emergency.

The company may need to reschedule a booking for reasons of its own, such as an illness, a material delay or a fault in the room. Where that happens, the client is told as soon as possible and offered the next available slot. No cancellation charge is made to the client in those circumstances, and any deposit already paid is carried forward or returned.

Service Delivery on Site

Most work is carried out in the room on Tannery Lane, where the bench and the listening conditions are controlled. Where a visit to a client site is agreed, the engineer will describe the tools and materials that will be brought and the space that will be needed. The client is asked to provide access to the building and to a power point near the work area.

An engineer may decline to carry out a step where it would be unsafe, where it would breach a building rule or where the room is not in a fit state for the work. The decision is explained to the client at the time, and the visit is documented in the records. Where the work can be completed in the room instead, the desk will propose a new date.

The client is welcome to watch the work, but is asked to keep a respectful distance from the bench and to avoid handling tools or materials without permission. A listening round is more useful when the client is seated in the listening position rather than standing beside the engineer.

Materials and Lead Times

Some materials are ordered for a specific job. Hide is selected for grain and thickness, cloth is chosen for weave and openness, and plate stock is cut to the panel opening. Once a material has been cut or a hide has been selected for a client, it may not be possible to return it.

Lead times are estimated in good faith but depend on suppliers and on the condition of the stock on hand. Where a material is delayed, the desk will tell the client as soon as the delay is known and offer an alternative where one is available. A delay in one material does not entitle the client to cancel the rest of the job unless the delay is so long that the purpose of the engagement is lost.

Leftover material from a job is kept for a reasonable period in case a repair is needed and is then disposed of unless the client has asked for it to be returned. A client who wants to keep the offcuts should ask at the time of the booking.

Client Property in Our Care

When a cabinet or a driver is brought to the room, it is logged in and kept in a designated area. The client is given a short note describing the condition of the item on arrival, including any existing marks or damage. That note protects both parties if a question arises later.

The company takes reasonable care of client property but does not insure it against every risk. A client should tell the desk in advance if an item is insured separately or has a value that is higher than the ordinary value of similar equipment. Where a loss or a further mark occurs during the work, the desk will investigate and discuss a fair solution with the client.

Items left in the room for more than ninety days after a handover notice may be stored at a charge and may eventually be disposed of after written notice. The desk will always try to reach the client before taking that step, and will keep a record of each attempt to make contact.

Workmanship and Warranty

The company stands behind its workmanship. Where a fault appears in a repair within twelve months of the handover and the fault is traced to the work carried out by the company, the fault is corrected without charge. The warranty covers the labour of the company and any material supplied by the company that proves to be faulty in ordinary use.

The warranty does not cover damage caused by accident, misuse, damp, heat, pets, a power event or work carried out by another party. It also does not cover a driver or component supplied by the client, although the company will still help to arrange a solution. The measurement card and the handover note together form the record that supports a warranty claim.

A claim should be made to the desk as soon as a fault is noticed. The desk will ask for the card reference, a short description of the fault and, where possible, a photograph. Causing further damage by continuing to use a system with an obvious fault may limit what can be repaired under the warranty.

Limitation of Liability

To the extent permitted by law, the liability of TAT CHUAN AUDIO PTE LTD in connection with a service is limited to the price paid for that service. The company is not liable for indirect or consequential loss, such as lost income, lost use of a room or the cost of hiring replacement equipment, however that loss arises.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that the law does not allow to be limited. Where the law of Singapore gives a consumer a right that can not be excluded, these terms do not exclude that right and are read so that the right continues to operate.

The company is not responsible for the acoustic result in a room that it has not been asked to tune, or for a change in the sound caused by furniture, building work or a decision to move the cabinet after the handover. It is always willing to return for a further listening round if the room changes.

Indemnity

The client agrees to indemnify the company against a claim, a loss or a cost that arises from the client breaches these terms, from inaccurate information supplied by the client or from a failure to obtain a permission that the work required. This indemnity applies only to the extent that the claim is caused by the client and does not extend to a loss caused by the company.

Where a claim is made against the company by a third party, the company will tell the client promptly and will give the client the chance to respond. The client is expected to cooperate with the defence of the claim and to provide the information that is reasonably needed.

This clause survives the end of the engagement, because a claim can arise after the work has finished and the records have been closed.

Intellectual Property

The text, layout, illustrations, CSS construction and written guidance on this website belong to TAT CHUAN AUDIO PTE LTD or are used with permission. A visitor may quote a short passage with a clear credit and a link to the source page. A visitor may not copy the layout, the code or the written content for use on another website without written permission.

The records prepared for a client, including the measurement card and the handover note, are provided for the use of the client. The technical method used to prepare them remains the property of the company. A client may share the records with an engineer who is helping with a later repair, but may not publish them commercially without permission.

The company name TAT CHUAN AUDIO PTE LTD and the working name Tat Chuan Audio are used only by the company. A visitor may refer to the company by name in ordinary writing, but may not use the name or a confusingly similar name for a business of their own.

Confidentiality

Information that a client shares about a home, a cabinet, a collection or a listening habit is treated as confidential. It is used only to carry out the work and is not passed to another client or to a third party except where the work requires it or where the law demands it.

The company asks its team and its partners to keep client information confidential in the same way. A partner that receives a technical record is given only the part of it that the partner needs, and is asked to return or destroy it when the work is complete.

The obligation of confidentiality does not cover information that is already public, information that the client has shared openly, or information that must be disclosed to a regulator or a court. Where a disclosure is required, the company will tell the client unless the law forbids it from doing so.

Visitor Conduct in the Room

The listening room is a calm place, and visitors are asked to help keep it that way. Telephones should be set to silent during a listening round, food and drink should stay away from the bench, and visitors should not touch a driver, a dial plate or a fitted panel without asking.

Smoking and vaping are not permitted anywhere in the building. A visitor who arrives in a condition that makes it unsafe to be in the room may be asked to return at another time. This is rare, and the desk will always try to handle the situation discreetly.

The company may ask a visitor to leave where the visitor behaves in a way that is unsafe, abusive or disruptive to others in the building. In that case the engagement may be ended and any work already carried out may be charged. The visitor retains the right to raise a complaint about the decision.

Third Party Services and Links

The website may link to a third party website, such as a map service or a payment provider. Those services are controlled by their own operators and are governed by their own terms and privacy notices. The company does not control them and is not responsible for their content or their conduct.

Where a third party service is used to process a payment or to deliver a message, the client deals with that provider on the provider terms. The company remains responsible for its own obligations under this agreement, but not for a failure that lies entirely with the provider.

A link from this website is not an endorsement of everything on the destination site. A visitor should review the terms of a third party before sharing personal information or making a payment there.

Events Beyond Our Control

The company is not in breach of these terms where a delay or a failure is caused by an event beyond its reasonable control. Such events include a natural disaster, a fire, a flood, a severe storm, a power failure, an epidemic, a strike, a transport disruption, a failure of a supplier or a change in the law.

Where such an event occurs, the desk will contact affected clients as soon as it can and will propose a new date. If the event continues for a long period, either party may end the affected engagement, and any deposit that has not been used will be returned.

The company will still take reasonable steps to protect client property during such an event, including the cabinets that are in its care at the time.

Suspension and Termination

The company may pause work where an invoice remains unpaid, where the room is not safe to work in or where an issue needs to be resolved before the next step. The pause is explained in writing and is lifted once the issue is resolved.

Either party may end an engagement by written notice. Where the client ends an engagement, any work already carried out and any material already cut is charged, and any deposit beyond that amount is returned. Where the company ends an engagement for a reason other than a client breach, any unused deposit is returned and the records prepared to that point are given to the client.

Clauses that by their nature should continue after the end of an engagement, including confidentiality, intellectual property and limitation of liability, continue to apply after the engagement has ended.

Governing Law and Disputes

These terms are governed by the law of Singapore. The parties agree to try to resolve any dispute through discussion before taking a formal step. The first step is a written summary of the issue sent to the desk, followed by a meeting at the room or by telephone if a meeting is not practical.

Where a dispute can not be resolved by discussion, the parties agree to submit it to the courts of Singapore, which will have exclusive jurisdiction. Nothing in this clause prevents a consumer from using a statutory dispute resolution scheme that applies in the consumer jurisdiction.

The company keeps a record of each complaint and of the way it was resolved, so that lessons can be learned and so that a pattern of problems can be spotted before it becomes serious. A client who is unhappy with a resolution is welcome to write again with any point that was missed.

Changes to These Terms

These terms may be updated from time to time to reflect a change in the services, in the law or in the way the company works. An updated version replaces the earlier version on the day it is published, and the effective date at the top of the page is revised at the same time.

A booking that was confirmed before a revision continues under the terms that were in force when it was confirmed, unless the revision is required by law or the client agrees to the new version in writing. The desk keeps a copy of each version so that this can be checked.

Where a change is significant, the desk will make it visible on the website rather than rely on a quiet edit, and will mention it in the next communication with an affected client.

Contact Details

Questions about these terms, a quotation, an invoice or a booking should be sent to the desk. The desk is the first point of contact for every matter described in these terms and will either answer directly or pass the matter to the person responsible and confirm that it has been passed on.

The desk answers during business hours and aims to reply within one working day. A request that concerns a legal right, an invoice dispute or a warranty claim is logged and given a reference so that its progress can be tracked and a clear answer can be given in writing.
